1. Introduction
Welcome to Four Elements Chile. We are an agency specializing in the organization of tailor-made sports travel experiences. By using our services, you agree to be bound by the following terms and conditions. We recommend that you read them carefully before making any booking.
2. Services
We offer the organization and sale of personalized sports travel packages, which may include transportation, accommodation, and high-risk sports activities, among others. The specific details of each package are agreed upon with the client prior to booking.
3. Bookings and Payments
3.1. Booking: To confirm a booking, a non-refundable initial payment of 50% of the total package cost is required.
3.2. Full Payment: The total payment must be made at least 7 days prior to the start date of the trip.
3.3. Payment Methods: We accept payments via bank transfer, PayPal, or cash.
3.4. Price Changes: We reserve the right to adjust prices in the event of fluctuations in transportation, accommodation rates, or other external factors. Any changes will be promptly communicated to the client.
4. Cancellations and Refunds
4.1. Cancellation by the Client: Cancellations must be made in writing. The amount of the refund will depend on the time remaining before the trip and the policies of our suppliers.
4.2. Cancellation by the Agency: We reserve the right to cancel a trip due to force majeure, unavailability of services, weather changes, or any other justified reason. In such cases, a full refund of the amount paid will be provided (minus 5% for service fee.)
4.3. No-Show: If the client fails to attend any activity or service included in the package, no refunds or changes will be granted.
4.4. Activity Cancellation by Guide Decision: If an activity cannot be carried out due to the guide's decision, motivated by factors such as adverse weather conditions, natural hazards, or other circumstances compromising safety, a proportional refund of the cost for that activity will be made. This refund applies only to the activities not conducted, excluding other services already provided or utilized, such as transportation or accommodation.
5. Modifications
5.1. Modifications by the Client: Any request to modify a package must be made well in advance and is subject to availability and possible additional costs.
5.2. Modifications by the Agency: We reserve the right to modify the itinerary or contracted services in the event of unforeseen circumstances, always ensuring a service of equivalent or superior quality.
6. Liability
6.1. Agency Liability: We act as intermediaries between the client and service providers (transportation, accommodation, events, etc.). We are not responsible for acts or omissions of these providers or for situations beyond our control (strikes, social conflicts, etc.).
6.2. Client Liability: The client is responsible for complying with all travel regulations, including visas, vaccinations, and required documentation. Additionally, the client is responsible for their behavior during the trip and for any damage caused to third parties or to the properties used.
7. Cutting Your Trip Short
If you are forced to return home early, we cannot refund the cost of any tour arrangements you have not used.
If you cut short your tour and return home early in circumstances where you have no reasonable cause for complaint about the standard of accommodation and services provided, we will not offer you any refund for that part of your tour not completed, nor will we be liable for any associated costs you may incur.
Depending on the circumstances, your travel insurance may offer coverage for curtailment, and we suggest that any claim be made directly with them.
8. IF YOU CANCEL YOUR RESERVATION BEFORE DEPARTURE**

If you or any other member of your group decides to cancel a confirmed booking, you must notify us by email at info@fourelementschile.com as soon as possible. Your cancellation notice will only take effect when we receive it in writing at our offices, and it will be effective from the date we receive it.

If one or more members of a group cancel, this may increase the per-person price of the tour for those still traveling, and you will be responsible for covering this increase.
Since we incur costs when canceling your arrangements, you will be required to pay the following cancellation fees:| Period before departure when we receive your notice

9. Insurance
We recommend that all our clients purchase travel insurance that covers accidents, illness, cancellation, loss of luggage, and other unforeseen events.
10. Data Protection
10.1. Data Collection: We collect and use clients' personal data for the proper provision of our services and in accordance with Chilean Law No. 19,628 on the Protection of Private Life.
10.2. Confidentiality: We are committed to protecting the privacy and security of the personal data provided by our clients.
11. Intellectual Property
All content on our website, including texts, images, logos, and other materials, is protected by copyright and may not be used without our prior consent.
12. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of the Republic of Chile. Any disputes arising in connection with our services will be subject to the exclusive jurisdiction of the courts of Santiago de Chile.
